Jack Fitzsimmons called the meeting to order at 6:55 p.m.
Post Hearing Agenda:
1. Administrative Approval (SE 43-2029) Michael Trudeau, 79 Pickerel Cove Circle: The agent described the request from Cape and Islands Engineering for an administrative review to change the footprint of the approved house footprint. The change involved a reduction in size. Jeff Cross expressed concern that consultants should be present at the meeting for administrative approvals. The agent explained that admin approvals are fairly innocuous and generally small in scope, therefore it is not necessary to have consultants present at the meetings. Upon further inspection of the plan with the new footprint, it was unclear as to whether or not the deck, patio and screen porch were to be included in the new plans or not. Until this information is furnished,
the concom decided to deny the request for admin approval.
Motion made, seconded and unanimously approved to deny this administrative approval.
2. Administrative Approval (SE 43-2408) Robert Stow, 25 Monomoscoy Rd West: The agent informed the concom that there was not enough information supplied to adequately present this request for approval from Cape and Islands Engineering. The request was for a “quash” aqua cultural device to be added to Mr. Stow’s walkover structure.
Motion made, seconded and unanimously approved to deny this admin approval.
Hearing Agenda:
7:00 p.m. Bonnie Smith, 256 Monomoscoy Rd (NOI): The applicant requested that the hearing be continued to 4/5/07 @ 7:00 p.m.
Motion made, seconded and unanimously carried for a continuance to 4/5/07 @ 7:00 p.m.
7:03 p.m. Jeffrey Cross, 86 Waterway (RDA): Project proposal to install 3 sections of fiber roll to protect eroded areas of coastal bank and salt marsh. Jeff Cross had to recuse himself because it is his own project. This left the concom 1 member short of a quorum and hence the hearing had to be continued at the request of the applicant.
Motion made, seconded and unanimously carried for a continuance to 3/22/07 @ 7:09 p.m.
7:06 p.m. Mark Jennings, 24 Spoondrift Way (RDA): Upgrade existing septic system. Jack Vaccaro represented the client and described the project. The old septic is to be abandoned and a new title V septic is to be installed further away from the resource area on the opposite side of the property. The agent said that the project meets the performance standards and recommended approval.
Motion made, seconded and unanimously approved for a negative determination.
7:09 p.m. Joseph Cariglia, 58 Triton Way (NOI): After-the-fact filing to reconstruct and maintain 130 linear feet of stone revetment on a coastal bank. Tim Santos of Holmes and McGrath represented the client and described the project. Mr. Santos informed the commission that a request was made in 2006 for added repairs to Mr. Cariglia’s revetment wall. Permission was granted for repairs; however, the concom agents discovered on a site visit back in January 2007 that the footprint of the wall had been increased landward by an additional 130 linear feet. Mr. Santos explained that the reason for the expansion was to match the existing grade of the revetment walls on either side of the property for overall continuity. A stop work order was in place until the
consultants were notified of the violation and subsequently had to file after the fact for a permit. The consultant described how disturbed areas would be jute-matted and planted with amophela to restore stability and prevent erosion.
The agent asked Mr. Santos if there was a planting plan in place for the easement once the work was finished and also if there was a chance that the gap between Mr. Baudanza and Mr. Cariglia’s revetments could be bridged in the future. Mr. Santos said that there is a planting plan in place for the easement supplied by Mr. Baudanza as well as jute matting for the top of the bank at the end of the easement. Mr. Santos said that Mr. Cariglia is willing to pay for his portion of the bridged gap between his home and Mr. Baudanza’s home. Mr. Santos said that Holmes and McGrath had sent out a letter to Mr. Baudanza in regards to bridging the gap in revetment walls and are still waiting to hear back from him. The agent recommended approval

7:12 p.m. Joseph Cariglia, 64 Triton Way (NOI): After the fact to reconstruct and maintain 135 linear feet of stone revetment on a coastal bank. Tim Santos from Holmes and McGrath represented the client and described the project. This is the same project as the 7:09 hearing only the repairs are on the opposite side of Mr. Cariglia’s revetment wall. The agent recommended approval.

7:15 p.m. William Cuming Trust, 357 Simons Narrows Rd (NOI)- continued from 2/22/07: The applicant requested a continuance to 3/22/07 @ 7:03 p.m.

7:18 p.m. David Barry, 90 Pequot Ave (NOI) –continued from 2/22/07: The applicant requested a continuance to 3/22/07 @ 7:06 p.m.
